These Terms govern your use of the Nestoa iOS app and website. By using Nestoa, you agree to them. If you do not agree, do not use the service. Questions may be sent to dahmann@lumyn.cc.
Eligibility
You must be at least 18 and legally able to agree to these Terms. Nestoa currently provides English-language, U.S.-oriented general guidance. Services, laws, and professional duties differ by location.
What Nestoa provides
Nestoa provides general educational decision and conversation support for family-caregiving situations. It can help organize facts you provide, suggest possible next steps and words to use, and create records for your own planning.
What Nestoa does not provide
Nestoa is not emergency response, medical care, diagnosis, psychotherapy, legal advice, financial advice, case management, adult-protection investigation, or a substitute for qualified professionals. It does not determine capacity, guarantee safety, or guarantee an outcome. No therapist-client, physician-patient, lawyer-client, fiduciary, or other professional relationship is created.
Emergencies
Do not use Nestoa or email support when someone may be in immediate danger. Call local emergency services. In the United States or Canada, call 911. For suicidal or emotional crisis support in the United States or Canada, call or text 988.
Your responsibility
You are responsible for reviewing what Nestoa gives you, correcting assumptions, deciding what is appropriate, protecting other people’s information, and obtaining qualified help for consequential decisions. AI responses may be incomplete, inaccurate, or inappropriate despite safeguards.
Acceptable use
Do not use Nestoa to harm, threaten, deceive, surveil, exploit, discriminate against, or unlawfully control another person; obtain an unauthorized diagnosis or capacity determination; generate illegal instructions; attack or bypass service safeguards; overload the service; reverse engineer protected service components; or submit information you are not entitled to use.
Nestoa may decline out-of-scope requests, limit usage, suspend access, or disable features to protect people, the service, or other users.
Privacy and other people’s information
Your use is subject to the Privacy Policy. Share only the minimum information needed and avoid unnecessary names or identifying details. You are responsible for having an appropriate basis to enter or share information about another person.
Subscriptions
Paid access is offered as an auto-renewing App Store subscription. Price, currency, trial if any, billing period, and renewal terms are shown in Apple’s purchase sheet and control the transaction. Payment is charged to your Apple ID. Manage or cancel in Apple subscription settings. Cancellation takes effect after the current paid period unless Apple states otherwise. Refund requests are handled under Apple’s policies and applicable law.
Ownership
Nestoa and its content, software, design, guides, and trademarks are owned by Nestoa or its licensors. You retain rights in information you submit. We give you a limited, personal, revocable, nontransferable right to use the service under these Terms.
Availability and changes
We may add, change, suspend, or discontinue features and areas of guidance. We do not promise uninterrupted or error-free availability. Information saved on your device may remain available when new online help is unavailable, subject to your device and app state.
Disclaimers and liability
To the extent permitted by law, Nestoa is provided “as is” and “as available,” without warranties of accuracy, fitness for a particular purpose, noninfringement, or uninterrupted operation. To the extent permitted by law, Nestoa and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, loss of data, or decisions made based on the service. Rights that cannot lawfully be excluded remain unaffected.
Apple terms
These Terms are between you and Nestoa, not Apple. Apple is not responsible for Nestoa or its support. Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to the licensed iOS app and may enforce those provisions.
Changes and contact
We may update these Terms and will change the effective date. Material changes may require notice or renewed agreement in the app. Contact dahmann@lumyn.cc with questions.
